Website Hosting Terms of Service
Last updated: October 1, 2026
These Website Hosting Terms of Service (“Terms”) constitute a legally binding agreement between Phoenix Moirai LLC (“Phoenix Moirai LLC,” “Company,” “we,” “us,” or “our”) and the individual or legal entity purchasing or using our hosting services (“Customer,” “you,” or “your”).
By purchasing, accessing, or using Phoenix Moirai LLC’s website hosting services (the “Services”), you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree to these Terms, you may not use the Services.
1. Hosting Services
Phoenix Moirai LLC provides shared website hosting services, including server space, network connectivity, website hosting infrastructure, and related services.
The features and resources available to you depend on the hosting plan you purchase. Hosting plans may have limitations relating to storage, bandwidth, CPU usage, memory, databases, email, processes, or other resources.
Phoenix Moirai LLC reserves the right to modify, upgrade, or discontinue portions of the Services when reasonably necessary. We will provide reasonable notice of material changes where practical.
2. Account Registration
To use the Services, you must provide accurate and complete account, contact, and billing information.
You are responsible for:
- Maintaining accurate account information;
- Keeping your payment information current;
- Maintaining the confidentiality of your account credentials;
- All activity occurring through your account; and
- Immediately notifying Phoenix Moirai LLC of any unauthorized access to your account.
You may not use another person’s account or credentials without authorization.
If you purchase Services on behalf of a business or organization, you represent that you have authority to enter into these Terms on its behalf.
3. Billing and Payment
Phoenix Moirai LLC offers monthly and yearly hosting plans.
Monthly Billing
Monthly hosting fees are billed in advance on a recurring basis. Your subscription will automatically renew each month unless canceled in accordance with these Terms.
Yearly Billing
Yearly hosting fees are billed in advance for the applicable annual service period. Your subscription will automatically renew annually unless canceled in accordance with these Terms.
Payment Authorization
By purchasing a recurring hosting plan, you authorize Phoenix Moirai LLC or its designated payment processor to charge your selected payment method for applicable recurring fees, taxes, and other authorized charges.
You are responsible for all applicable taxes and governmental fees associated with your purchase.
Phoenix Moirai LLC reserves the right to change hosting prices upon reasonable notice. Price changes generally take effect at the beginning of the next applicable billing period.
4. Refund and Cancellation Policy
Monthly Hosting Plans
Monthly hosting fees are generally non-refundable after the 15th day of the applicable calendar month.
If you cancel a monthly hosting plan after the 15th of the month, you will not receive a refund for that month’s hosting fee, regardless of the remaining portion of the month.
If you cancel on or before the 15th of the month, a full refund for that month will be administered.
Yearly Hosting Plans
If you cancel a yearly hosting plan, Phoenix Moirai LLC will refund the portion of the prepaid annual fee attributable to full unused months remaining in the applicable annual service period.
Partial or incomplete months are not included in the refund calculation.
For example, if a yearly hosting plan has six complete unused months remaining at the time of cancellation, the refund will be calculated based on those six full unused months.
Any initial or other fees specifically identified as non-refundable remain non-refundable unless otherwise required by applicable law.
Required Legal Rights
Nothing in this section limits any refund, cancellation, or other consumer rights that cannot legally be waived under applicable law.
5. Paid Technical Support
Standard hosting support covers issues relating to the operation of the Phoenix Moirai LLC hosting environment.
Additional technical assistance is available as a paid support service at a rate of $75 per hour.
Paid support is subject to a one-hour minimum per request. After the first hour, additional time may be billed in 15-minute increments determined by Phoenix Moirai LLC.
Paid support may include, depending on the request:
- Website troubleshooting;
- Configuration assistance;
- Hosting-related troubleshooting;
- Application or CMS assistance;
- Website migrations;
- Database assistance;
- Email configuration;
- DNS assistance; and
- Other technical services agreed upon by Phoenix Moirai LLC.
Paid support does not guarantee that a particular issue can be resolved.
Work involving third-party software, applications, plugins, themes, scripts, or services may require additional time or may not be fully supported.
Phoenix Moirai LLC may require authorization before beginning paid support work that will result in billable charges.
6. Acceptable Use
You agree to use the Services only for lawful purposes and in compliance with these Terms.
You may not use the Services to:
- Violate any applicable federal, state, local, or international law or regulation;
- Infringe or violate another person’s intellectual property, privacy, publicity, or other legal rights;
- Distribute malware, viruses, ransomware, spyware, or other malicious software;

- Engage in any activity that presents an unreasonable security, legal, operational, or reputational risk to Phoenix Moirai LLC or its customers.
Phoenix Moirai LLC may investigate suspected violations and may take reasonable action to protect its infrastructure, customers, and third parties.
7. Shared Hosting Resource Usage
Because Phoenix Moirai LLC provides shared hosting, multiple customers may use resources on the same server infrastructure.
You agree not to use your hosting account in a manner that materially impacts server performance, network availability, or other customers.
Phoenix Moirai LLC may contact you if your account uses an excessive or abnormal amount of server resources.
If necessary, Phoenix Moirai LLC may require you to reduce resource consumption, upgrade to a different service, or take other reasonable measures.
Phoenix Moirai LLC may temporarily restrict or suspend an account when reasonably necessary to protect server stability, security, or other customers.
8. Customer Content
You retain ownership of websites, files, databases, text, images, applications, and other content that you upload or store using the Services (“Customer Content”).
You grant Phoenix Moirai LLC a limited, non-exclusive right to host, store, transmit, copy, and process Customer Content solely as reasonably necessary to provide, maintain, secure, and operate the Services.
You are solely responsible for Customer Content and represent that you have all rights, permissions, and licenses necessary for Phoenix Moirai LLC to host and process it.
Phoenix Moirai LLC does not claim ownership of Customer Content.
9. Backups
Phoenix Moirai LLC provides daily backups as part of its hosting services.
Backups are intended to provide a means of recovering Customer Content in the event of accidental deletion, corruption, hardware failure, or similar incidents.
However, backups are not guaranteed to capture every file or database change, and Phoenix Moirai LLC does not guarantee that any particular backup will be available or successfully restored.
Backup retention periods are generally thirty (30) day cycles, but may vary by hosting plan or may be changed by Phoenix Moirai LLC upon reasonable notice.
You remain responsible for maintaining independent backups of critical or irreplaceable data.
Phoenix Moirai LLC will make reasonable efforts to restore data from available backups when requested. Backup restoration may be subject to applicable support charges unless restoration is included in your hosting plan.
Phoenix Moirai LLC is not responsible for losses resulting from the failure of a backup or the inability to restore Customer Content, except to the extent liability cannot legally be excluded.
10. Security
Phoenix Moirai LLC will use commercially reasonable measures to maintain the security of its hosting infrastructure.
However, no hosting environment or Internet transmission can be guaranteed to be completely secure.
You are responsible for maintaining the security of:
- Your account credentials;
- Website applications;
- Content management systems;
- Plugins and extensions;
- Themes;
- Scripts;
- Databases;
- Email accounts; and
- Other software installed or controlled by you.
You should promptly install security updates and maintain strong, unique passwords.
You must notify Phoenix Moirai LLC promptly if you believe your account has been compromised.
If Phoenix Moirai shall determine that your site has been compromised by any type of virus, malware, or malicious software, javascript, or PHP, we have the right to shut down all services until all security issues have been resolved.
11. Third-Party Software
The Services may permit you to install and operate third-party software, including content-management systems, plugins, themes, scripts, applications, and other software.
You are responsible for obtaining appropriate licenses and complying with the terms applicable to such software.
Phoenix Moirai LLC does not guarantee the security, functionality, compatibility, or continued availability of third-party software.
Phoenix Moirai LLC may require removal or disabling of software that creates a security, performance, or operational risk to the hosting environment.
12. Domain Names
If Phoenix Moirai LLC provides domain registration or management services, domain names are subject to the rules and policies of the applicable domain registrar and registry.
You are responsible for maintaining accurate domain-registration information and paying applicable domain registration and renewal fees.
Phoenix Moirai LLC does not guarantee the availability of any requested domain name.
Domain registration is separate from website hosting unless expressly included in your hosting plan.
13. Service Availability
Phoenix Moirai LLC will make commercially reasonable efforts to maintain the availability of its hosting services.
Unless you have entered into a separate written Service Level Agreement (“SLA”) with Phoenix Moirai LLC, no specific uptime guarantee is provided.
Service interruptions may occur because of maintenance, upgrades, hardware or software failures, network problems, security incidents, third-party provider failures, or circumstances beyond Phoenix Moirai LLC’s reasonable control.
14. Scheduled Maintenance
Phoenix Moirai LLC may perform scheduled maintenance, upgrades, repairs, and other work necessary to maintain or improve the Services.
Where reasonably practical, Phoenix Moirai LLC will provide advance notice of significant scheduled maintenance.
Emergency maintenance may be performed without advance notice when reasonably necessary to protect the Services or customers.
15. Suspension of Services
Phoenix Moirai LLC may suspend or restrict access to all or part of the Services if:
- Payment is overdue;
- You violate these Terms;
- Your account creates a security or operational risk;
- Your account has been compromised or is reasonably suspected of being compromised;
- Your activity materially affects other customers or the hosting infrastructure;
- Your use of the Services is unlawful;

Where reasonably practical, Phoenix Moirai LLC will provide notice and an opportunity to correct the issue before suspension.
16. Termination
You may cancel your hosting Services at any time, subject to the applicable refund provisions in these Terms.
Phoenix Moirai LLC may terminate your account for material violations of these Terms, non-payment, unlawful activity, abuse of the Services, or other circumstances permitted by law.
Upon termination, your right to access and use the Services ends.
You are responsible for obtaining copies of your Customer Content before termination.
Phoenix Moirai LLC may delete Customer Content following termination after a reasonable period, subject to applicable law and any separate agreement concerning data retention.
17. Intellectual Property
Phoenix Moirai LLC and its licensors retain all rights, title, and interest in Phoenix Moirai LLC’s websites, software, systems, documentation, trademarks, logos, and other proprietary materials.
These Terms do not transfer ownership of Phoenix Moirai LLC’s intellectual property to you.

Some jurisdictions do not permit certain limitations of liability. Accordingly, some portions of this section may not apply to you.

26. Changes to These Terms
Phoenix Moirai LLC may update these Terms from time to time.
If material changes are made, Phoenix Moirai LLC will provide reasonable notice where required by applicable law.
Your continued use of the Services after the effective date of updated Terms constitutes acceptance of the updated Terms to the extent permitted by law.
27. Governing Law
